Please read these Terms carefully. By accessing or using Lease-A-Dock, creating an account, listing a dock, or making a booking, you agree to be bound by these Terms of Service and all applicable laws. If you do not agree, do not use the platform.
Marketplace Intermediary — No Party to Rental Agreements
Lease-A-Dock, operated by ILM Holdings LLC ("Platform"), is a technology marketplace that connects dock owners ("Dock Owners") with individuals seeking to rent dock space ("Renters"). The Platform does not own, operate, inspect, insure, or manage any dock listed on the site.
When a booking is made through the Platform, a binding Dock Rental Agreement is formed directly and exclusively between the Dock Owner and the Renter. ILM Holdings LLC dba Lease-A-Dock is not a party to any Dock Rental Agreement and assumes no responsibility or liability for the obligations of either party under that Agreement.
By using the Platform to list or book dock space, you acknowledge that:
- All disputes regarding the condition of dock space, vessel damage, personal injury, or rental terms are between the Dock Owner and Renter directly.
- The Platform's role is limited to facilitating introductions, processing payments as agent, and providing booking management tools.
- The Platform's total liability to any user shall not exceed the platform service fees collected for the specific booking giving rise to the claim.
Indemnification
You agree to indemnify, defend, and hold harmless ILM Holdings LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Platform; (b) your listing or booking of dock space; (c) your violation of these Terms; or (d) your violation of any third-party right, including any intellectual property right or privacy right.
Dock Rental Agreement
Each booking on the Platform is subject to a separate Dock Rental Agreement electronically executed by the Dock Owner and Renter at the time of booking. The Dock Rental Agreement governs the specific terms of the rental, including dates, pricing, obligations, liability, and dispute resolution. In the event of conflict between these Terms of Service and a specific Dock Rental Agreement, these Terms of Service govern with respect to the Platform's rights and obligations, and the Dock Rental Agreement governs with respect to the obligations between the Dock Owner and Renter.
Governing Law
These Terms of Service and all Platform-related disputes are governed by the laws of the State of Florida. Any claims against ILM Holdings LLC shall be brought exclusively in the state or federal courts of Broward County, Florida.
1. Eligibility & Account Registration
You must be at least 18 years of age and legally capable of entering into binding contracts to use Lease-A-Dock. By creating an account, you represent and warrant that all information you provide is accurate, current, and complete.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at support@leaseadock.com of any unauthorized use of your account.
Accounts are personal and non-transferable. You may not create multiple accounts to circumvent any suspension, ban, or restriction imposed by Lease-A-Dock.
3. Dock Owner Responsibilities
By listing a dock or boat slip on Lease-A-Dock, you represent and warrant that:
- You are the legal owner of the property or have express written authorization from the owner to list and rent the space.
- The listing accurately describes the dock, its condition, available amenities, access restrictions, and any known hazards.
- The dock complies with all applicable federal, state, county, and local laws, regulations, zoning ordinances, and HOA or marina rules.
- You hold any permits, licenses, or authorizations required to rent out the dock space in your jurisdiction.
- You carry adequate property and liability insurance covering third-party use of the dock.
- You will promptly notify renters of any material changes to the dock, access, or availability.
- You will honor confirmed bookings and communicate promptly with renters through the platform.
Owners are solely responsible for determining their tax obligations related to rental income, including but not limited to Florida state sales tax, local tourist development taxes, and federal income tax. Lease-A-Dock does not provide tax advice.
4. Renter Responsibilities
By booking a dock through Lease-A-Dock, you agree to:
- Use the dock only for the purposes and vessel types described in the listing and confirmed in the booking.
- Comply with all applicable federal, state, and local maritime laws, USCG regulations, and waterway rules.
- Leave the dock in the same condition in which it was received, reasonable wear excepted.
- Carry adequate marine insurance covering your vessel and any liability arising from your use of the dock.
- Respect the Owner's house rules, quiet hours, and any access restrictions specified in the listing.
- Report any damage to the dock, equipment, or surrounding property to the Owner immediately.
- Not sublet, transfer, or share access to the dock with any third party not named in the booking.
Renters are solely responsible for verifying that the dock is suitable for their vessel (size, draft, beam, bridge clearance, water depth) before completing a booking. Lease-A-Dock does not verify the accuracy of listing details.
5. Bookings & Cancellations
Booking Confirmation: A booking is not confirmed until the Owner explicitly accepts it. Owners have the right to decline any booking request without cause.
Cancellations by Renter: Cancellation terms are set by each Owner and displayed on the listing page prior to booking. Lease-A-Dock's platform fee is non-refundable in all cases unless the cancellation is due to a verified listing inaccuracy.
Cancellations by Owner: Owners who cancel confirmed bookings may be subject to penalties including temporary listing suspension and negative impact on search ranking. Renters will receive a full refund including service fees for Owner-initiated cancellations.
Disputes: Any disputes regarding booking condition, access, or refunds must be raised within 24 hours of check-in by contacting Lease-A-Dock support. After this window, all charges are considered final.
No-Shows: If a renter fails to check in without prior cancellation, no refund will be issued. If an Owner fails to provide access, the renter is entitled to a full refund.
6. Payments & Fees
Lease-A-Dock charges a tiered platform service fee added to the renter's total at checkout. The fee rate depends on the booking subtotal as follows:

These rates are subject to change with reasonable notice. The applicable fee will always be clearly displayed before you confirm your booking. This fee compensates Lease-A-Dock for providing the platform, payment processing, and support services.
Owners receive 100% of their listed nightly, weekly, or monthly rate. Payouts are processed after renter check-in confirmation, subject to any applicable holds for dispute resolution.
All payments are processed through our payment partner. By using the platform, you agree to their terms and payment processing policies. Lease-A-Dock does not store full credit card information.
In the event of a chargeback or payment dispute initiated by a renter that Lease-A-Dock determines to be fraudulent or in bad faith, the renter's account may be suspended and the renter may be liable for the full booking amount plus any associated fees.
7. Insurance & Liability
Both Owners and Renters are strongly encouraged to carry appropriate insurance. Lease-A-Dock does not provide insurance to either party.
- Owners should carry commercial or landlord liability insurance covering dock rental activities, as standard homeowner policies typically exclude commercial rental activity.
- Renters should carry marine insurance covering their vessel, liability, and any on-dock activity. Some marinas and dock owners may require proof of insurance as a condition of docking.
Lease-A-Dock expressly disclaims all liability for:
- Damage to, theft of, or loss of any vessel, equipment, or personal property
- Personal injury or death occurring at or near any listed dock
- Environmental damage including fuel spills, bilge discharge, or hazardous material release
- Damage caused by weather, tidal surge, or Acts of God
- Any loss arising from inaccurate listing information
To the maximum extent permitted by applicable law, Lease-A-Dock's total liability for any claim arising from use of the platform shall not exceed the total fees paid by the user to Lease-A-Dock in the 12 months preceding the claim.
8. Prohibited Conduct
You agree not to use Lease-A-Dock to:
- List or rent dock space you do not own or have authorization to rent
- Conduct any illegal activity, including illegal dumping, drug trafficking, or smuggling
- Circumvent the platform by arranging payments outside of Lease-A-Dock after initial contact through the platform
- Post false, misleading, or fraudulent listings
- Harass, threaten, or discriminate against other users
- Use automated tools to scrape, crawl, or manipulate the platform
- Violate any applicable maritime, environmental, or local zoning law
- Engage in any activity that damages, disables, or impairs platform infrastructure
Violation of these prohibitions may result in immediate account termination and, where applicable, referral to law enforcement authorities.
9. User Content
By submitting photos, descriptions, reviews, or any other content to Lease-A-Dock, you grant us a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute that content in connection with operating and promoting the platform.
You represent that you own or have the right to submit all content you provide, and that such content does not infringe the rights of any third party. Lease-A-Dock reserves the right to remove any content that violates these Terms or that we determine to be inappropriate in our sole discretion.
Reviews must be honest, first-hand accounts. Incentivized, fabricated, or retaliatory reviews are prohibited and will be removed.
10. Intellectual Property
All platform content, design, software, trademarks, and branding belonging to Lease-A-Dock are our exclusive property and are protected by applicable intellectual property laws. You may not copy, reproduce, or create derivative works based on our platform without express written permission.
11. Termination
Lease-A-Dock reserves the right to suspend or permanently terminate any account at any time, with or without notice, for any violation of these Terms, fraudulent activity, or conduct that we determine to be harmful to the platform or its users.
You may deactivate your account at any time by contacting support. Outstanding booking obligations survive termination — you remain responsible for honoring or properly cancelling any confirmed bookings at the time of termination.
12. Dispute Resolution & Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any legal action arising from these Terms or your use of the platform shall be brought exclusively in the state or federal courts located in Broward County, Florida.
Before initiating any legal proceeding, you agree to first contact Lease-A-Dock at legal@leaseadock.com and make a good-faith effort to resolve the dispute informally within 30 days.
Class Action Waiver: You agree to resolve any disputes with Lease-A-Dock on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.
13. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify registered users by email and update the "Last updated" date at the top of this page. Continued use of the platform after the effective date of any changes constitutes your acceptance of the revised Terms.
